These Terms of Use (“Terms of Use”) govern how you may access and use the Harmony Street mobile application available on iOS and Android (the “App”). The App is owned and operated by Harmony Street Society Foundation (“Harmony Street,” “we,” “us,” or “our”).

By accessing or using the App, you agree to comply with these Terms of Use. If you do not agree, you must not use the App.

1. Purpose of the App

Harmony Street is designed to help musicians organize and manage financial and activity-related information, including income, expenses, receipts, and gig scheduling.

The App is intended for personal organizational use only and does not provide professional, financial, tax, or legal advice.

2. Eligibility to Use the App

You must be at least 13 years of age to use the App.
By using the App, you confirm that you meet this age requirement.
Users under 13 are not permitted to use the App, and accounts found to violate this rule will be terminated.

3. Account Usage Rules

When using the App, you agree that:

You will create and maintain only one account for personal use.
All information you provide will be accurate and up to date.
You are responsible for all activity that occurs under your account.
You will keep your login credentials confidential.

You must not allow any third party to access or use your account.

4. Acceptable Use

You agree to use the App only for lawful and intended purposes. You may not:

Use the App for fraudulent, illegal, or deceptive activities
Upload false, misleading, or unlawful content
Attempt to gain unauthorized access to any system, account, or data
Interfere with or disrupt the App’s operation or security
Reverse engineer, modify, or tamper with the App or its code
Use the App in a manner that violates any applicable law or regulation

5. User-Generated Content

The App allows you to input and upload content, including financial entries, notes, and receipt files (“User Content”).

You retain ownership of your User Content; however, by submitting it, you grant Harmony Street a limited license to store, process, and display the content solely for the purpose of providing App functionality.

You are solely responsible for the accuracy, legality, and completeness of all User Content.

6. No Professional Advice

Harmony Street does not provide:

Tax advice
Legal advice
Financial planning advice
CPA or accounting services

All data, reports, and exports generated by the App are provided for informational and organizational purposes only. You should consult qualified professionals for tax, legal, or financial decisions.

7. Subscriptions & Access Control

Certain features of the App require an active subscription after any applicable free trial period.
Access to features may be limited, suspended, or restricted if a subscription expires or is canceled.
Subscription management, billing, and cancellation are handled exclusively through Apple App Store or Google Play Store.

8. App Availability & Updates

We strive to keep the App available and functional but do not guarantee uninterrupted access.
We may update, modify, or discontinue features at any time.
The App may be temporarily unavailable due to maintenance, updates, or technical issues.

Harmony Street is not responsible for losses resulting from App downtime or feature changes.

9. Intellectual Property

All rights, title, and interest in and to the App, including software, content, design, trademarks, and logos, are owned by Harmony Street Society Foundation or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes only.

You may not copy, distribute, sell, sublicense, or exploit any part of the App without prior written permission.

10. Account Suspension & Termination

We may suspend or terminate your access to the App if you:

Violate these Terms of Use
Misuse or abuse the App
Engage in conduct that poses a security, legal, or operational risk

You may terminate your use of the App at any time by deleting your account through the App.

11. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law:

We make no warranties regarding accuracy, reliability, or fitness for a particular purpose.
We do not guarantee that the App will be error-free or meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by law, Harmony Street shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities
Errors or omissions in user-entered information

Your use of the App is at your own risk.

13. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to conflict-of-law principles.

Any legal action must be brought exclusively in the courts located in Louisiana.

14. Changes to These Terms of Use

We may update these Terms of Use from time to time.

If changes are material, we will notify users through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
